The Italian Competition Authority has published new merger-control turnover thresholds. From 2 April 2013, a transaction must be notified when both of the following conditions are met:
- the combined aggregate Italian turnover of all undertakings concerned exceeds €482 million; and
- the aggregate Italian turnover of the target undertaking exceeds €48 million.
A previous reform made the thresholds cumulative from 1 January 2013. The change was expected to reduce the number of merger notifications substantially and allow the Authority to concentrate resources on larger transactions and antitrust enforcement.

L’Autorità Garante della Concorrenza e del Mercato ha pubblicato le nuove soglie di fatturato per la notifica delle operazioni di concentrazione. Dal 2 aprile 2013, un’operazione deve essere notificata quando entrambe le seguenti condizioni sono soddisfatte:
- il fatturato totale realizzato in Italia dall’insieme delle imprese interessate supera €482 milioni; e
- il fatturato totale realizzato in Italia dall’impresa oggetto dell’acquisizione supera €48 milioni.
Una precedente riforma aveva reso cumulative le soglie dal 1° gennaio 2013. La modifica era destinata a ridurre sensibilmente il numero di notifiche e a consentire all’Autorità di concentrare le proprie risorse sulle operazioni di maggiori dimensioni e sull’attività antitrust.
